1. Introduction
These are the terms and conditions that apply when you reserve a room at Kingfisher Hotel, Golf and Country Club.
You will be asked to confirm your acceptance of these terms and conditions when you make a reservation.
We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a reservation. The terms and conditions applying to your reservation will be those in place on the date that you make your reservation.
Additional terms apply to your use of our digital channels whether or not you make a reservation through them. These are published on the relevant digital channel.
2. Reservations
To reserve your room please follow the instructions as applicable.
You must be at least 18 years old to make a reservation.
You will need to provide your credit or debit card details to secure your reservation. Kingfisher Country Club accepts Visa, Visa Debit, American Express to secure a reservation.
Please check that the details of your reservation are complete and accurate before you confirm your reservation. We will not be liable for any delay if you provide us with incorrect information.
We will confirm our acceptance of your reservation by sending you a confirmation email to the email address that you provide during the reservation process. The contract between us for the provision of your room and any additional services added to your reservation will be formed when you receive this email confirmation from us.
If you think that there is a mistake in your reservation or if you require any changes to a confirmed reservation, please contact us to discuss. For more information on cancellation, please see section 10 Cancellation, below.
3. Group reservations
A reservation of five rooms or more is a group booking. If you wish to make a group booking if 6+ rooms, please call our central reservation team on 01908 562332.
4. Room prices
Kingfisher Hotel adopts dynamic pricing and the price of our rooms fluctuates based on demand. When you make a reservation request, we'll give you a total price for the rooms and number of nights you've requested. The price you pay is the price quoted to you at the time you make your reservation.
Room prices are per room, per night and are inclusive of VAT at the applicable rate at the time of your reservation. Breakfast is included in all our room rates.
Flexible Rate: If you book a Flexible rate you may choose whether to pay for your room in full at the time of booking or to pay on arrival or departure. Please see section 10 cancellation for full rate restrictions.
Pre-Purchase Rate: Pre-Purchase rates are a more restricted rate that may be offered subject to availability. Payment in full is required for all ‘Pre-Purchase’ bookings and will be taken during the period between (a) the date your booking was made and (b) your scheduled arrival date (as shown on your booking confirmation). This is at the hotel’s discretion. This is inclusive of all extras ordered at the time of booking.
Should we be unable to process your card details to take this payment for any reason your reservation will be deemed invalid and a bedroom(s) may not be reserved for you. Whilst every effort is made to advise you in this event, it remains your responsibility to ensure that the hotel has been able to do so. Please see section 10 cancellation for full rate restrictions.
5. Occupancy
The maximum room occupancy is three persons, not exceeding two adults.
The provision of cots are available for children up to 3 years old and are included in the infant rate of £10. Daybeds are available for children aged between 4-17 years and are included in child rate of £10.
Daybeds (for children 4-17 years old) are available with a maximum occupancy of two adults and one minor.
We are unable to accommodate both travel bedding types or more than one type (travel cot, or a travel daybed), in our bedrooms.
Please give sufficient advance notice at the time of booking. You must not exceed the maximum occupancy for the room allocated to you. We reserve the right to conduct checks on occupancy. Occupancy is not transferable.
Children under 18 are not permitted to stay at Kingfisher Hotel unless a parent or guardian is also staying in the hotel. We reserve the right to request valid photographic proof of identity and age, so please bring this with you otherwise where requested you may not be permitted to stay.
6. Meals
Breakfast is included in the room price for both adult and child rates.
You may add a Dinner inclusive deal when you make your reservation. The Evening meal deal is available for adults only and includes a three course £35 dinner allowance from the TDH menu and/ or as advertised in-house.
We reserve the right to change our menu offering seasonally and as required.
7. Child Policy
Access to the Health Club Spa, Sauna and Steam Room facilities is restricted to those aged 13 years and under and Fitness Suite 16 years and under.
With a full paying adult, children under 2 eat free. Children’s meals are charged as taken at the published menu(s) and prices.
Please note that we are unable to allow children to stay in our suite and we respectfully ask that all children vacate Five Restaurant and Spectrum Lounge by 9.30pm at the latest.
8. Accessibility
Kingfisher Hotel has two rooms which are specially adapted for customers with disabilities. For more information view our Access Statement.
9. Special requests
Although Kingfisher Hotel will try to accommodate special requests, all rooms are subject to availability.
We are unable to accept foreign currency exchange at Kingfisher Hotel and you will need to visit an exchange bureau or bank to exchange your currency.
10. Cancellation
Your right to cancel
‘Flexible’ rate plans may be cancelled up to 24 hours of the arrival date. If you cancel your reservation up to 24 hours on the day of arrival and have paid for the room in advance by debit/credit card, a full refund will be processed to the same debit/credit card normally before 9am the next working day though it may take a few days for the funds to reach your account. A cancellation reference will be given and should be retained as proof of cancellation.
If you cancel a reservation on the day of arrival and have not already paid for the room in advance you will be charged a cancellation charge equivalent to 50% of the total charges reserved for the duration of your stay. A cancellation reference will be given and should be retained as proof of cancellation.
If you decide to shorten your stay you must inform reception giving at least 24 hours of the day you wish to check out. Otherwise you will be charged a cancellation charge equivalent to one night’s total accommodation per room booked and for any meals and other extras booked for the following day.
Any ‘no show’ will be charged at 100% of the charges reserved.
‘Pre-Purchase’ rate plans may be cancelled however are non-refundable under all circumstances.
If you’ve made a group booking, our cancellation terms are as follows:
· For 6 rooms or more and irrespective of any Flexible-Rate plan in place, we’ll need a 50% deposit 28 days before arrival and the balance 14 days before arrival. These payments are non-refundable, but you can cancel your booking free of charge if you do so before we take a deposit.
Where you cancel (including any “no show”) a group booking and there is a non-refundable payment retained by us, this total amount is a cancellation charge to compensate the hotel for the cancellation and is not for any service.
Our right to cancel
Your breach
We may cancel your reservation at any time with immediate effect by giving you written notice (which includes email) if:
· you do not pay us when you are required to do so; or
· you break the contract between us in any way.
If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract. Where your stay had/has not yet commenced, the total payment made or to be made by you for such room shall be deemed a cancellation charge and is not for any service.
11. Force Majeure
We may also cancel your reservation or appointment if an event outside of our control or the effect of any Force Majeure situation at the hotel or elsewhere (including industrial action, explosion, fire, flooding, and failure of power and/or water supplies or emergency evacuation) means that we are unable to make services available to you. In this case we will contact you to let you know as soon as possible and:
· if you have already paid for your room, we will refund your payment to you; or
· if you have not yet paid for your room, you will not have to make any payment to us.
Same as set out above, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our control. The hotel shall not be responsible or liable in any way (including financial) for any interference with or disturbance to, including cancellation or curtailment to that booking or appointment, resulting directly or indirectly from the Force Majeure situation. This does not affect your statutory rights.
12. Parking
The hotel cannot guarantee space availability in the hotel car park at any time and parking is available on a first come first serve basis.
The hotel may withdraw or suspend its parking facilities at any time without notice.
The hotel car park is strictly for the use of the hotel guests and visitors and Heath Club/ Members only.
Vehicles must be parked in the defined limited of a single parking space.
All vehicles parking in a space designed as being for use by either a ‘Disabled Permit Holder’ or ‘Authorised Permit Holder’ must clearly display an appropriate valid current permit.
All use of the hotel car park shall be entirely and absolutely at the users risk and the hotel accepts no liability for any loss or damage to any vehicle, however caused, including the removal by the hotel of any unauthoirsed or incorrectly parked vehicle from the car park.
13. Paying for your room
All bookings must be guaranteed with a valid debit/ credit card at the time of booking.
Please note we are unable to use a third party credit cards to settle any outstanding balance outside of the confirmation terms even if it was used to secure the booking. We will require a card to be physically present in order for it to be used as a means of payment to charge incidentals to your bedroom account.
All guests will be asked for a debit/ credit card (chip and pin) preauthorisation upon check-in at the hotel. Our preauthorisation policy amount is a sum of the total charges reserved for your stay (if not pre-paid), plus £50 per adult, per night to cover incidental charges to the bedroom account.
Where the reservation has not been pre-paid, a minimum pre-authorisation amount to cover the total charges reserved must be taken using debit/ credit card. Guests will be considered as ‘pay as you go’, and expected to pay for any additional services using cash or card at the hotel outlets.
Where a preauthorisation is taken, full payment must be completed upon departure (which must be chip and pinned). Where it is not possible to preauthorise the total room charges reserved, Kingfisher Hotel reserves the right to cancel your reservation at 100% cancellation fee. For more information on cancellation, please see section 10 Cancellation.
Payment may be made by credit/debit card (Visa, Visa Debit, MasterCard, American Express). The expiry date of your debit/credit card must be later than the end of your stay. We do not accept cheques or cash at reception.
In the case of AMEX cards, particularly (but not restricted to) those issued oversees, which must be ‘swiped’ rather than chip and pinned the hotel reserves the right to check validity of the card with the AMEX voice authorisation service and/ or our Merchant. Cards which are not authoirsed will not be accepted.
Guests are required to clear all outstanding balances with Reception upon check-out.
14. Arrival and departure
Rooms are available from 3pm on the arrival date. Please let Kingfisher Hotel know if you are likely to arrive after 10pm.
Guests will be asked to provide proof of identity and nationality upon check-in. Overseas guests, excluding Republic of Ireland and Commonwealth citizens, will be asked to provide their identity card / passport details. Acceptable forms of identification are: a passport, driving licence, ID card or police warrant card.
Rooms must be vacated by 11:00am on the day of departure. Failure to leave your room by this time may result in a late check-out charge.
15. Smart TVs : Security and Data Protection
All our bedrooms and suite features a smart TV and you are invited to enjoy the many extra viewing opportunities provided. However, please note that if you input any personal account details, pin numbers, passwords or other personal information into this TV, unless all such information is removed by you before you leave your bedroom, it could possibly enable anybody entering your room after you, to gain access to those applications which you have accessed and possibly to gain access into your personal data.
Please therefore be absolutely sure to delete any personal information you have entered (whatever its nature) before leaving your bedroom. For example, if you enter your Netflix account ‘sign in’ details to access Netflix services, you must be sure to ‘sign out’ of your account – not to just simply exit the app. This is crucial for your data security. Please be advised that the hotel will not under any circumstances be responsible or liable to you in any way should you enter any information, whether you have signed out / deleted it or not.
Any decision by you to enter any information or details is done entirely at your own risk.
16. Guest own food preparation/ cooking in bedrooms and public areas
Any form of food preparation and/ or cooking in the bedrooms or public areas is strictly prohibited. This includes (but is not restricted to) the use of portable smoothie blenders, sandwich toasters, or crock-pots. In addition, kettles provided by the hotel may only be used for the purpose of boiling water to make hot beverages and not as a means of cooking/ boiling other foodstuffs (whether in water or otherwise).
17. Kingfisher Hotel expectations of you (and your group)
You must not:
· smoke anywhere inside any Kingfisher premises. This includes the smoking of e-cigarettes. Permitted smoking areas will be identified on site. Smoking on Kingfisher premises outside of the designated smoking area will result in a £250 fine;
· bring any pets onto hotel premises, with the exception of assistance dogs;
· bring any potentially dangerous or hazardous materials or equipment onto Kingfisher Hotel premises;
· use any electrical appliances that may set off the fire alarm system;
· tamper with any fire alarms or emergency equipment;
· utilise Kingfisher rooms to use or store items (personal or otherwise) which could in the sole opinion of Kingfisher Hotel cause damage to the room, or be a risk to the health and safety of staff or property. This includes any items with a naked flame;
· prevent Kingfisher Hotel management, housekeeping and/or maintenance staff from access to your room(s) as and when required by Kingfisher Hotel, with housekeeping permitted full access at least once every two days;
· remove, damage or destroy any Kingfisher Hotel property;
· use any of the technology provided by Kingfisher Hotel to download or access any unlawful or obscene material; or cause unreasonable disturbance to our other guests or any Kingfisher Hotel staff.
If you or your group cause damage or loss of any kind to the hotel, other guests or their property, you (as the person making the booking) will be responsible for that damage or loss and you shall be liable to pay to Kingfisher Hotel on demand the amount required to make good or remedy such damage or loss.
You and the members of your group must not resell or transfer your reservation (or any part of it) nor advertise, market or otherwise offer any Kingfisher Hotel room for sale either on its own or as part of a combined offer. Kingfisher Hotel will not honour any reservations made in this way and does not accept any liability for doing so. If you are a Tour Operator and wish to book rooms at a Kingfisher Hotel you should contact Kingfisher Hotel directly on 01908 562332.
If you or your group cause damage to the hotel, other guests or their property, or otherwise breach any of these terms and conditions, Kingfisher Hotel reserves the right to:
· cancel your reservation with immediate effect and (if appropriate) eject you from the premises;
· cancel key cards;
· restrict access to the hotel;
· remove your items from the room and hotel, disposing of such items (at no cost and no liability) to a local charity to the extent such items are not collected from us within 7 days of removal;
· retain all sums paid by you and/or charge you the full amount of your reservation; and/or
· refuse future reservations from you and/or refuse you entry or accommodation at any of our hotels.
Kingfisher Hotel will not be liable for any refund or compensation in such circumstances.
Kingfisher Hotel reserves the right to decline or cancel reservations made and stays in progress by those who have previously breached these terms and conditions (as may be updated from time to time), whether the reservation is in that name or not.
We reserve the right to change your room allocation at any point during your stay for any reason.

Your information
We keep your personal data safe and secure. Full details about how we use your data are set out in our Privacy Notice. Similar to other commercial websites, this website and the System utilises a standard technology called cookies and web server logs to collect information about how the website and/or the System is used and how to improve them. Further details can be found in our Cookie Notice. By providing information about you and your booking group (as outlined in the Privacy Notice) when making a reservation, you consent (on your behalf and on behalf of each member of your group) to such processing and you warrant that all information provided by you is accurate.
The contract
This contract formed when we confirm your reservation is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.
Your rights
If you are a non-business customer you have certain rights under consumer protection legislation. Nothing in these terms and conditions is intended to affect those rights.
Our liability
We accept liability for death and personal injury arising from our negligence or that of our employees and agents. We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or agents.
We do not accept liability for failure to meet any of our obligations where such failure is due to events beyond our reasonable control.
If we breach these terms and conditions for reasons within our control we shall only be liable for losses that are direct losses and a reasonably foreseeable consequence of such breach.
Save as prohibited by applicable law, we shall not be liable whether in contract, tort (including negligence) or for breach of statutory duty, or in any other way, for any indirect or consequential losses including:
· loss of income, sales or revenue;
· loss of business;
· business interruption;
· loss of profits or contracts;
· loss of anticipated savings;
· loss of data;
· loss of reputation and/or goodwill; or
· wasted management or office time.
Where we are liable to you (save as prohibited by applicable law) our maximum liability to you whether in contract, tort (including negligence) or for breach of statutory duty shall in no event exceed the price of your reservation unless the Hotel Proprietor's Act 1956 applies, in which case our liability will be limited to the maximum prescribed under that Act.
Applicable law
These terms and conditions, their subject matter and formation (and any non-contractual disputes or claims) are governed by and construed in accordance with English law.
If you are a consumer you and we both agree that the courts of England and Wales will have non-exclusive jurisdiction over any claim arising from, or related to, your reservation and/or stay at Kingfisher Hotel. We retain the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country. If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
If you are making a business reservation, you and we agree that the courts of England and Wales will have exclusive jurisdiction over any claim arising from, or related to your reservation and/or stay at Kingfisher Country Club.
Severability
If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies.
All rights not expressly granted in these terms and conditions are reserved.

Personal information we collect:
We collect personal information when you book with us or request or use our services. This includes hotel and restaurant visits, using our websites or apps, or corresponding with us. We may also receive personal data about you from another source. This includes:
• Personal Identifiers - title, name, marital status, postal and email addresses, postcode, IP addresses and contact telephone numbers. We may also collect the names of those who are part of a group booking where necessary, and the age of children to meet your needs (e.g. to provide a cot) and enable us to confirm any restrictions that may apply to a room booking;
• Business-to-Business Information - for corporate customers and corporate business leads and contacts: job title, business address and business email address;
• Transaction Information - payment, reservation and booking details, including meals, beverages & car parking;
• Membership information - membership details for rewards and Kingfisher Country Club Ltd Business Account programmes;
• Shareholder information – where you present a Kingfisher Country Club Ltd shareholders’ card;
• Facebook Page Insights Data - In relation to our Facebook Pages, we may receive Insights Data from Facebook, i.e. aggregated data that can help us to understand how visitors are engaging with our Page, which may be based on personal data collected during your visit to our Page or its contents. In relation to the processing of this personal data only, we are joint controllers with Facebook Ireland Limited. How do we use your information, and what is the legal basis for this use?

These guests will be asked to complete a registration form and provide their identity card/passport details, to comply with the Immigration (Hotel Records) Order 1972, as amended. Acceptable forms of identification are: a passport, driving licence, ID card or police warrant card.

We will share your personal data with Kingfisher Country Club and other companies in the Kingfisher Country Club Ltd group for administering hotel and restaurant services & products. Kingfisher Hotel shares data within Kingfisher Country Club Ltd when providing with support, advisory, IT, safety and security, including CCTV, and other services.

Service Providers
For some activities Kingfisher Hotel uses third party service providers including where we are joint controllers. o administer bookings; provide Wi-Fi; undertake customer feedback surveys; provide analytics; send promotional offers; provide personalised advertisements; provide insurance; provide IT development, support, maintenance and hosting, including the provision of applications and website hosting; process payments to enable you to pay by credit or debit card; provide credit checks and fraud checks; and provide CCTV systems and maintenance.

Personal data may be shared with regulators, government authorities and/or law enforcement officials for the prevention or detection of crime, if required by law or if required for a legal or contractual claim or regulatory purposes.
We disclose your personal data to payment providers, technology providers, insurers, and other specialist professional and technical advisers to manage your bookings, arrange payments and provide services.
With your consent, we will also disclose your personal data to Ombudsman services and Citizens’ Advice.
Restructure and sale
We may restructure our internal group of companies so that different group companies run our hotels and related services. So, for example, in the future Kingfisher Country Club Ltd (or another group company) may take over responsibility for the running and operation of hotels from Kingfisher Hotel. If this happens we will let you know and your data may be shared with such company and processed as set out in this notice.
In the event that the business is sold or integrated with another business, your details may be disclosed to our advisers and any prospective purchaser’s adviser and will be passed to the new owners of the business.
International transfers
Sometimes we may need to send or store your data outside of the European Economic Area (the EU plus Iceland, Lichtenstein and Norway) (‘EEA’). For example, to follow your instructions, comply with a legal duty or to work with or receive services from our service providers who we use to help run your accounts and our services.

How long will you retain my personal data?
We keep your data to enable us to fulfil our contract with you or to provide services, where required by law, to respond to a question or complaint, to obey rules about keeping records, to uphold or protect contractual or legal rights or where it is in your or another party’s vital interests or our legitimate interests. Where we process personal data on the basis of your consent, we will retain it only for as long as required for the specified purpose. • until a period of 3 years has elapsed since your last interaction with us, personal data we process for marketing (including profiling) purposes, unless you ask us to stop sending electronic direct marketing, in which case we will act on your request, and then keep a record of your request indefinitely;
• for 3 years in the case of accident report forms (or for accidents relating to a child, for 3 years after the child’s 18th birthday);
• for up to 6 years from your last stay or access to your account, any personal data in an account you have set up with us, for example a My Kingfisher Account or Business Booker Account;

GENERIC BOOKINGS’ TERMS
All bookings are subject to availability.
All bookings are subject to a discretionary service charge of 10%.
Bookings of 6 or more guests need to be placed by phone directly with our reservation team or by email.
For bookings where a deposit is taken, the deposit will be redeemed against your final bill. In the event of a cancellation with less than 48hrs notice your deposit will not be refunded.
Reservations can be made online through our website and using our third-party booking system “TOCK”.
Bookings can also be made directly in situ, by phone on 01908 562332 or by emailing us to fb@kingfishercountryclub.com
Please specify the day and time of your booking, number of people, contacts of main organiser and dietary requirements when placing your enquiry.
Bookings made online through our reservation system are automatically confirmed as soon as you receive email confirmation.
Enquires for bookings made by any other means are only confirmed after our team processes it, checks availability and contact you directly with confirmation. We attempt to answer to your enquires in 2 business days. If you don’t hear from us by then, please kindly contact us again.
Booking’s confirmation can be done by phone or email, to any of your contacts provided.
Card details might be required to confirm your reservation.
We do not hold your card details in file. This information is processed and secured by a third-party card processing company. For specific information on how we treat and store your data check our privacy policy.
In the event that the booking is not honoured in whole or in part, or it is cancelled with less than 7 days’ notice, a cancellation fee of £50 per person might be applied.
If we attempt to contact you to confirm your booking and are unable to reconfirm your booking 7 days prior to your required date, we reserve the right to release the table.

COVID-19 BOOKINGS REQUIREMENTS
All guests in your party must check in individually by using the provided NHS app QR Code.
If this is not possible, names, phone numbers and emails will be collected by our team.
All guests are required to use face coverings while indoors in our venues unless dining.
We operate with TABLE SERVICE only. Direct serving at the bar is not allowed.
Payments to be made by card, preferably.
Subject to government restrictions, at the moment the total number of guests in your party is 6. This restriction is due to be lifted by the 21st June. Please confirm with us directly before booking your party for more than 6 guests.
